Pasay Court Dismisses Acts of Lasciviousness Charges Against Contractors in Sandro Muhlach Case
The Pasay Metropolitan Trial Court dismissed acts of lasciviousness charges against contractors Jojo Nones and Richard Cruz in the Sandro Muhlach case, ruling that the accusations were already part of the rape charges filed by the DOJ.
The Pasay Metropolitan Trial Court has dismissed one of the charges against independent contractors Jojo Nones and Richard Cruz in connection with actor Sandro Muhlach's alleged sexual assault.
In a report by State of the Nation on Wednesday, Branch 46 of the Pasay court granted their motion to quash two counts of acts of lasciviousness filed against them.
The court ruled that filing the acts of lasciviousness charges was excessive since such acts are already considered an element of rape through sexual assault—a charge that the Department of Justice had already filed before the Pasay Regional Trial Court.
It stated that the accusations of lascivious conduct were already included in the rape case and criticized the prosecution for what it called an "overkill" approach in filing the additional charges.
