The DPC's four-year investigation revealed that TikTok permitted remote access to European user data by employees in China without implementing safeguards equivalent to EU standards. Additionally, TikTok initially claimed it did not store EU user data in China but later admitted that some data had been stored there, contradicting earlier statements. -
Regulatory Actions:
TikTok has been ordered to bring its data processing activities into compliance with GDPR within six months. Failure to do so will result in the suspension of data transfers to China. The DPC emphasized that TikTok did not adequately assess the risks of Chinese authorities accessing European user data under local laws. -
TikTok's Response:
TikTok plans to appeal the decision, asserting that it has implemented measures to enhance data security, including its €12 billion "Project Clover" initiative aimed at strengthening data protection for European users. The company maintains that it has never provided European user data to Chinese authorities. -
Previous Penalties:
This is not the first time TikTok has faced regulatory action in the EU. In 2023, the DPC fined the company €345 million for mishandling children's data, highlighting ongoing concerns about TikTok's data privacy practices.
